These Terms of Service (“Terms”) govern access to and use of monster-presents.com, Monster HQ, ticketing and event services, applications, communications, and related services operated by Dragvertising, LLC, doing business as Monster Presents!™ (“Monster Presents!”). By using the services, creating an account, submitting a form, or purchasing a ticket, the user agrees to these Terms and the Privacy Policy.
1. Eligibility and event restrictions
Users must be able to form a binding agreement under applicable law. A parent or legal guardian must authorize use by a minor where permitted. Individual events may have age, identification, accessibility, conduct, or venue requirements shown on the event listing or ticket page. Admission may be refused when those requirements are not met.
2. Accounts and Monster HQ
Account information must be accurate and kept current. Users are responsible for protecting credentials and for activity under their accounts. Shared, transferred, automated, or unauthorized access is prohibited. Suspected unauthorized access should be reported promptly to [email protected].
3. Tickets, orders, and payments
Prices, taxes, fees, inventory, seating, delivery methods, and purchase limits are shown during checkout or by the third-party ticket seller. Orders are not complete until payment is accepted and confirmation is issued. Refund, cancellation, postponement, transfer, and resale rules displayed for the event or by the ticket seller apply to that purchase. Event-specific terms control if they conflict with these general Terms. Payment processors and ticketing platforms may apply additional terms.
4. Event changes and admission
Lineups, performers, schedules, venues, seating, menus, features, and production details may change. Monster Presents! may postpone, relocate, modify, or cancel an event when reasonably necessary for safety, artist availability, venue conditions, force majeure, or other operational reasons. Any available remedy will be governed by the event-specific policy, ticket seller rules, and applicable law.
5. Conduct at events
Guests must follow venue rules and reasonable instructions from staff, security, performers, and emergency personnel. Harassment, threats, violence, discrimination, unsafe conduct, illegal activity, unauthorized recording, interference with a performance, and damage to property are prohibited. A guest may be removed without a refund when permitted by law if conduct creates a safety risk, disrupts the event, or violates these Terms or venue rules.
6. Accessibility and accommodations
Requests for reasonable accommodations should be made as early as possible through the event contact or [email protected]. Monster Presents! will work with venues and partners to address requests, but available accommodations can depend on the venue and the timing of the request.
7. Applications, bookings, talent, and vendor services
Submitting an application, booking request, proposal, or vendor inquiry does not guarantee selection, engagement, compensation, exclusivity, or event participation. Separate written agreements, production rules, releases, or event terms may apply. If a separate signed agreement conflicts with these Terms, the signed agreement controls for its subject matter.
8. User content
Users retain ownership of content they submit. By submitting content to the services, the user grants Monster Presents! a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, and display that content only as reasonably necessary to operate the services, review the submission, fulfill the request, or perform an applicable agreement. The user represents that submitted content is lawful and that the user has the rights needed to provide it.
9. TikTok and connected services
An authorized user may connect TikTok or another third-party service to Monster HQ. The user directs the transfer of information covered by the permissions approved during authorization. The connection may be used to identify the authorized account and display permitted profile, statistics, or public-content information in the dashboard. Third-party platforms control their own services and may change or end access. Users may disconnect a connected service at any time through the available account controls or by contacting Monster Presents!.
10. Acceptable use
Users may not misuse the services; attempt unauthorized access; interfere with security or operation; scrape, reverse engineer, or copy protected portions except as allowed by law; upload malware; impersonate another person; infringe intellectual property or privacy rights; use the services for fraud or unlawful activity; or use automated systems in a way that places an unreasonable load on the services.
11. Intellectual property
The Monster Presents! name, logos, site design, software, original productions, event concepts, text, graphics, audiovisual material, and other content supplied by Monster Presents! are owned by Dragvertising, LLC or its licensors and are protected by intellectual-property laws. No license is granted except the limited right to use the services for their intended purpose. Third-party names and content remain the property of their respective owners.
12. Third-party services and links
The services may link to or integrate with venues, payment processors, ticket sellers, social platforms, maps, media, and other third parties. Monster Presents! does not control those services and is not responsible for their availability, content, security, or practices. Use of a third-party service is governed by its own terms and privacy policy.
13. Disclaimers
To the maximum extent permitted by law, the services are provided on an “as is” and “as available” basis. Monster Presents! does not guarantee uninterrupted operation, error-free content, availability of any performer or event feature, or that every service will meet a user’s expectations. Nothing in these Terms excludes warranties that cannot legally be excluded.
14. Limitation of liability
To the maximum extent permitted by law, Dragvertising, LLC and its owners, employees, contractors, affiliates, venues, and production partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits or data, arising from the services or an event. Total liability for a claim relating to a paid transaction will not exceed the amount paid by the claimant for the transaction giving rise to the claim. These limits do not apply where prohibited by law.
15. Indemnification
To the extent permitted by law, a user agrees to defend and indemnify Dragvertising, LLC and its affiliates from claims, losses, and reasonable costs arising from the user’s unlawful conduct, violation of these Terms, infringement of another person’s rights, or content submitted by the user.
16. Suspension and termination
Access may be suspended or terminated when reasonably necessary to address a Terms violation, security risk, legal requirement, nonpayment, fraud, abuse, or harm to the services or another person. Provisions that by their nature should survive termination will remain effective.
17. Governing law and disputes
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Courts with jurisdiction in Michigan will have jurisdiction over disputes, except where applicable consumer law requires another forum. Before filing a claim, the parties should attempt in good faith to resolve the matter by contacting [email protected].
18. Changes and general terms
Monster Presents! may update these Terms as services or legal requirements change. The revised version will be posted with a new effective date. If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, event-specific terms, and any applicable signed agreement form the complete agreement for their respective subject matter.
